Christmas 2016 / New Year 2017 Public Holidays
It’s hard to believe that Christmas is just around the corner!
With these Christmas/New Year public holidays, Christmas day and New Year’s Day will both transfer to the Tuesday. How should you pay your Employee’s?
If Sunday 25 December 2016 or Sunday 1 January 2017 is an otherwise working day for the Employee, the public holiday is observed on this day. This means that should the Employee work on this day, you are required to pay them T1.5 for each hour worked, and they would accrue an alternative (lieu) day. If it is an otherwise working day for the Employee, and they do not work, you are required to pay their Relevant Daily Pay (or Average Daily Pay). In these situations, Sunday 25 December and Sunday 1 January do not transfer to the Tuesday.
If Sunday 25 December or Sunday 1 January is not an otherwise working day, the public holiday will transfer to, and be observed on Tuesday 27 December or 3 January. If the Employee does not work on Sunday 25 December or Sunday 1 January, but does work on Tuesday 27 December or Tuesday 3 January, public holiday rates would apply on the Tuesday, i.e. T1.5 and an alternative day. However, in this situation if the Employee does not work on Sunday 25 December, Tuesday 27 December, Sunday 1 January, 27 December or Tuesday 3 January, then you are required to pay their Relevant Daily Pay (or Average Daily Pay) for both Tuesdays.
Monday 26 December 2016 (Boxing Day) and Monday 2 January 2017 are both observed on these days and do not automatically transfer to another day.
Employees are only entitled to a maximum of four (4) public holidays over the Christmas/New Year period, with each public holiday being observed once.
How to pay staff can be daunting if they are working in accordance with a roster. Should you have any staff working on rostered shifts, please call us if you require clarity in such situations.
